A couple of things to point out.

Anyone that has ever gotten an email from you, anyone you have ever given an email to during an online transaction, communication, etc. might be source of where that company got your email from.

There are a lot of marketing companies that are just looking for valid email addresses so they can send you advertisements.

Most of these "random" emails come from these kinds of companies that do a bulk email send. They then await one of a few things:

a-You reply. That means your email address is good and you read what you get. These emails stay on the list.

b-It bounces back to them with a server message that says it's a bad email address. They get removed.

c-You just read the email. If there are any graphics in the email, even a single pixel, it "echos" back to their server with a download request, thus confirming your email address is a good one.

Most of he time your email address is shared company to company, because it's in the "terms of agreement" or "privacy policy" of a website, software pkg., free email account.

They will ONLY keep sending you email if you keep reading or responding.

Suing them? Try suing a ghost. What you can do.

A-Ignore them and don't read them

B-Turn up your spam filter. It might also give you the option to add specific email addresses to REJECT. When that happens the email company "bounces" them like you were an invalid email address.

C- Get an additional email account and use that one for any "Email Required" to transact or activate anything.

If you didn't opt in by checking a box somewhere saying you'd like to receive email from them, then the opt out is probably just a way to validate your email address.

Turn off HTML email, allow plain text only. This kills the look of promotional emails you might have purposefully opted in to but it keeps the spam from sticking that pixel in there that hits their server validating your email address. Most legit promotions have a link you can click on to view the email on their website so you don't really miss out on anything.

Check your ISP's website, most have their own spam filters on the servers and an address you can forward spam to to get it added there. Adding the email to your own local spam list does not cause the "email company" to bounce it like an invalid address. It still gets to your inbox on the server, just not to your inbox on your computer. It's typically hard to block them yourself, they usually fake most of the information identifying the email, including the from address. Modern spam filters use a statistical analysis of the words in the email. That's why you get spam with typos and weird spaced in the middle of words. They are trying to trick the filters. But they work better than blocking an address and this is probably what your ISP has.
