: I have been scammed!!!
seabees72ss Jan 8th, 09, 10:39 PM Well,
As you all know I just bought the 72 Chevelle back in late October. The guy I bought it from Bobby Shipman from Irving, Texas was supposed to deliver it yesterday. We agreed on the price, I sent him a check from my bank and it was a done deal. Three times he was suppose to deliver it, and it never happened. First time it was due to ice storms, second time he had the flu, this time??? I had many emails and acouple of phone calls from him since October, even called my wife...seemed like a good guy. Now this scum bag sends an email to my wife saying"Check is in the mail" I don't know what to do, never been strung along on a ride like this. So, I guess I have to start looking for another car. It puts a real sour taste in my mouth for trying to work a deal over the internet. I already made two payments on the damn loan I took out.:sad:
oldtimeparts Jan 8th, 09, 10:50 PM Report him to the post office, sure looks like mail fraud to, hope you saved all the e-mails:(
1BLACKHARLEY Jan 8th, 09, 10:59 PM what do you mean check in the mail ? what am i missing ? are you out the $ ? that's mail fraud, and a felony that carries hefty fines and prison time. did he decide not to go threw with the deal ? i'm sorry, i guess i'm behind the curve on this story.......
PCB67SS Jan 8th, 09, 11:09 PM Hopefully the check that is in the mail is a good check......Sure hope this works out for you and you at least get your money back.
seabees72ss Jan 8th, 09, 11:17 PM The check I sent him was from my bank USAA. I don't know what kind of check he is sending back to me. My bank is not open yet, so no way of figuring this out. I have bought many vehicles off ebay and what not, never had an issue like this. Yes, I saved all emails i sent him and the replies as well. I'm still on deployment, so it is a little tuff to get anything done quick.
fishhead Jan 8th, 09, 11:22 PM Tim,
Where you at?
T-Man Jan 8th, 09, 11:33 PM Report him to the post office, sure looks like mail fraud to, hope you saved all the e-mails:(
Hate to break the news but the post office will do nothing to help, been down this road with my own scam artist. I went to his town and signed a warrant for his arrest, that's how it works. I got most of my money back but not all as of today. He has an upcoming court date that may help him send the rest of my money back.
seabees72ss Jan 8th, 09, 11:57 PM Tim,
Where you at?
Yokosuka, Japan.

Tim, I hope it works out for you, and you get all your money back. But most of all....thanks for protecting our borders, so we can all sleep in peace tonight. Been there, done that, got the t-shirt. God Bless you and yours. JC
FerrariTruck Jan 9th, 09, 1:37 AM I'm sure we have some members who could live closeby to pay him a visit. It would be the least I could do If I was nearby irving texas
Bunz-T Jan 9th, 09, 4:58 AM What was the E=Bay #? Some of us Texas boys may can help.
novaderrik Jan 9th, 09, 5:33 AM this is one of many reasons i would never, ever buy a car without actually seeing it in person, driving it, and taking possession immediately after squaring away all paperwork and handing over the cash.
6704gto Jan 9th, 09, 8:38 AM been in the same sitution,u need to wait to see if the check is in the mail, the cops told me i would need to contact the police where the crime took place, which is imguessing is ur home.then u might have to contact the courts
bowtie6872 Jan 9th, 09, 9:40 AM woh slow down..
don't jump .and thing the worse..
maybe he strung him along because he can't let it go..
maybe the check really is in the maill..
not say'n it's right..
but..
lets see if the poster gets the check..
without hear'n the other side..
you don't know what the reason for the hold up is..
maybe the car.. was in an little miss hap.. and he thought if be fixed by now..
and strung him along ..hope'n ..
and finally ,just sent the money back..
who knows..
not everyone is out to screw everybody..
I hope he gets is money back..
and maybe that a bleessing..
and he's better off, than having the car..
texas had alot of floods.. since..
you know it could be the guy, couldn't cheat a guy serving our country..
and changed his mind on it.. and sent the check..
I could be totally wrong..
but I like to hope for the good in people first..
But, he posted he took out a loan, is the "seller" going to pay him back the principal + loan costs ?
bowtie6872 Jan 9th, 09, 10:04 AM But, he posted he took out a loan, is the "seller" going to pay him back the principal + loan costs ?
maybe .. if he is told about it..
I'd like to think not everyones an @$$..
I could be totally off base...
I had to return money once..
after car was hit.. the day I deposit the check..
light hit..
new bumper and grill..
sent the money back..
as it wasn't the same..
and wasn't fair to take the money, for a one owner, never hit.. car
that was now hit..
1970-Cloned Jan 9th, 09, 10:12 AM Never prepay with out recourse period. If was going to spend more than $10K on anything I will bring check or cash in hand and personally inspect the item.
Hopefully you will get the check back in the mail, cash it and take it as a lesson learned.
If he doesn't send your money back you are kind of ***** out of luck. By the time the courts are involved you may or may not get your money back not including the years of holding your money.
I wish you the best.
PaPa Johns 77 Jan 9th, 09, 10:22 AM I had a cousin that was in the middle of a big messy divorce. He was ordered to pay his ex half the value of his Harley and his MG TC he had just restored as well as paying the half monthly mortgage on "her" house and child support.
He had a piece of property that he had inherited from great grandma that he put up for sale but it was not going to sell in time to comply with the court ordered payments.
So he did a less than honest thing. He put his MG up for sale and it sold but for less than he needed to pay his ex so he sold it again! Bad news right there!!
He paid her off and then started making excuses to the car buyers as to why it had not shipped yet. He strung them along for over 3 months.
Finally his property sold and he then sent the buyers money back but would not elaborate on why. He did at least add 10% to their refunds but it was still very wrong. Probably criminal thing to do. I'd say fraud.
I guess he just felt that he would do anything he could to keep from losing his two most prized posessions and gave no thought to the other guys and what they must be thinking.
I say he was lucky he was not sued over it. But the buyers were probably just relieved that they got their money back and let it go.
chevelledude71 Jan 9th, 09, 10:24 AM I hope you get your money back and if there is anything good from this. You just helped a LOT of people see what can happen out there.
I bought some door handles off ebay, they were worse than the ones I had on the car already. That was my turning point with ebay..not again and definitely with buying a car.
I hope Taz is right and there was a problem and the guy didn't want to stick you with a damaged car. But, this guy could have just picked up the phone and called your wife; nice guy you said.
oktunes Jan 9th, 09, 10:30 AM Hopefully enough guys will learn from this and from the other examples of buying cars long distance without seeing them, to learn that you are setting yourself up for an easy kill by not going to look and buy in person. We are talking about $20 thousand and more. Spend the time and money to go look in person and make the deal! don't trust someone you don't really know.
We are all buddies on this website, right. How many people on here would you trust enough to just send them $20 thou and hope for the best? Buy an airplane ticket for a couple hundred!

good point..
but he's in japan..
deployed..
so that be kinda hard..
oktunes Jan 9th, 09, 11:41 AM I'm sorry for the whole experience, but maybe if you are in Japan, you better wait till you get back in the states. If you have family or friends you can trust you would send them to personally do the deal.

Yup, totally off base.
:D
fishhead Jan 9th, 09, 12:44 PM About 5 years ago I bid on some computer parts on ebay. They never came. The seller had tons of stuff listed and then one day he was all gone.
I sent emails to all the other buyers and they didnt get their stuff either. We couldnt find a valid address anywhere. One buyer paid in a money order and clarified that it was cashed. We then knew that the seller had received the money order. We now had his address...
One of the buyers actually lived in the next town. He notified the police with the address and amazingly 2 weeks later I received my parts...
Perhaps someone here might live in the same town or close by that they could verify the guy still lives there...sorta do a little private eye...
Bunz-T Jan 9th, 09, 12:49 PM There are a lot of people on this sight I would trust more with my money in their hands helping me get the deal done. Too many times people get impatient and do not use the resources that are available to them here and set themselves up for this kind of aggrivation.
This case as an example....... There are so many members in the DFW area that could have inspected this car and sized the situation up. Even a guy like me that is 100+ miles way would probably go if everything else fails. I have a friend in the N Dallas area that has a classic car dealership that would have done the inspection and handled it at his place for a reasonable sum.
I still have trust in people and feel that so many people who have spent years building a reputation here are not going to sacrifice it and endure the humiliation and scorn. There are a lot of ways to make a long distant deal work if you will take your time. Try to force it and the dam will break.
1BLACKHARLEY Jan 9th, 09, 1:08 PM i think part of this is the issue we all have different standards, and quality is viewed differently in different regions. where say in socal, a car with rust is usually not an option, in other areas it's a given. i've bought several cars over the internet, and though i was a little dissapointed when they arrived, i never lost a $ on them, and have been told by many that those purchases, were well bought. funny thing is, the one car i actually went to personally inspect, was so bad, i just drove by the house and kept going...
i'm still not sure what this story is all about. i hope the check is good, but why didn't he just wire the $, at least it would have been instant, and less inconvenient for you.
it sucks that your paying on a loan for a car that basically doesn't exsist, and now after this b.s. you have to start all over. one benefit is, market is adjusting and you might get a nicer ride for your $. hang in there partner, hopefully something good will come of this...
70 beater Jan 9th, 09, 4:48 PM Got an address ? Can't be too far from me .
Not in the local yellow pages .
704EVER Jan 9th, 09, 4:57 PM Sorry to hear of your bad deal. I'm going to a couple of shows this weekend, I'll keep my eyes open for you!!
seabees72ss Jan 9th, 09, 5:50 PM Here is the latest emails from him. Someone early in the post hit the nail on the head. He strung me along waiting for more money, made a promise to deliver and then never did.
Bobby Shipman:
certified check from Chase bank 20K sending out friday morning FED X, it's more trouble then what's it's worth right now, the guy with 22K would take it as it is, maybe i need to do that, sorry
--- On Thu, 1/8/09
Bobby Shipman:
If you want the chevelle you need to come to Dallas Tx to get, i can't deliver it, i'm already out acouple of hundred dollars going back and forth to your bank and missing work, i spent most of the day today looking for the pistons i have to order them and i'm not going to anymore, the car is for sale as it is with the car cover, i'm not going to add any extras, the NOS bottle stays in the chevelle and the am radio is installed now, bring 22K and that's FIRM if not that's ok to.
--- On, Fri, 1/9/09
Now this is after I agreed to pay another $700 to him when it arrived at the house. $500 for delivery, and another 200 for the NOS bottle. The NOS bottle was included until Thursday when he sent another email stating that he forgot to mention it, but he would take $200 for it. So in total i would have ended up giving him 20,700.
I'm going to keep the loan and buy another Chevelle, once I find the right one. I'll be back from deployment soon and will make the purchase face to face.
PCB67SS Jan 9th, 09, 5:59 PM Tim thank goodness your getting your money back.....As you mentioned now is a good time to do some searching for your perfect car....I wouldn't deal with him now if he dropped the price 5k.....If a mans word is no good what else does he have left.....Who knows the bank may even hold the title......Keep safe and were all looking forward to your return.

Forgot to mention when I first contacted him about the car off of Racingjunk.com, he used the old, "I was in the Army" to gain my trust.
Twins Fan Jan 9th, 09, 7:08 PM "I was in the Army" to gain my trust.
Trust me with your life, but not your money or your wife (or Chevelle in this case)!:D
1badss396 Jan 9th, 09, 7:18 PM Tim, that was me that said he was stringing you along hoping to get more money from another buyer then turn the table back on you trying to squeeze more money out of you. Run from that deal it was not ment to be, and move on to a better find.

I plan too, I don't think I can trust anything he says. It is to bad because the car was really nice(or at least what I was told and shown) :(

Go to the Member Classifieds Forum and post a WTB thread (WTB = "Want to Buy"). You'll see others there, too.
When you find something that's interesting and would like someone to check it out for you, you can post a thread in Bench Racing that you need help getting a '72 checked out in XYZ city. You can usually count on someone helping you out if there's anybody in that city.
Especially when you're away serving our country!
Sid Coleman Jan 9th, 09, 8:22 PM Tim, if you find something, don't hesitate to ask a nearby member to check it out for ya. That way you've got a physical location and good set of eyes in place to look for ya.
Thanks for your service, from a fellow squid :)

BB68 Jan 9th, 09, 10:10 PM ACES1 had a very nice 72 SS for sale in the free classifieds, but it is already gone.
ACES1 Jan 9th, 09, 11:43 PM Well, the '72 is "Sold," but not gone yet. The "buyer" was supposed to overnight the $1000 deposit (shoulda got it yesterday), and pay/pick the car up next weekend. Haven't seen the deposit, and he hasn't returned my emails, but I'm gonna give him until next week to get the deposit to me.
Like Tim, I usually assume that folks will do what they say they will, but as we're all learning (or have already learned), that ain't always the case. Good luck getting your money back, and I hope you have a safe return trip home after your deployment.

And even if you do get your money back, I'd drive up there once you get back and dot the m-fer in the eye just for trouble he caused you...
One thing!!!! Make sure the Cashiers Check is of legal tender...
Here is why. My dad was selling a jeep on ebay a few years ago and the buyer sent him a cashiers check. When my dad looked at the check, the name on it was not the buyer's name. He called the bank that it was issued from and the bank told him that he has a stolen check. DO NOT CASH IT! If you do you will be liable for the amount.
The check was for half the amount agreed on and the other half would be sent once the jeep was shipped. Now if he had shipped the jeep he would be out the cost of the jeep and the amount of the check...
Good luck...
